Prominent Lawyer Lectures Pangilinan On Napoles Being A State Witness: Kiko Is Incorrect

Prominent lawyer and a member of the ''Impeach Leni Team" lectured Senator Francis "Kiko" Pangilinan on the statement he said that Janet Lim-Napoles can't be a state witness.

In a video posted on YouTube channel of Politiko, Pangilinan said:

Alam mo, malaking kababalaghan pag ginawa mong state witness kung sino mang nakipagsabwatan sa naparaming kongresista at senador.

Hindi tama ito.

However, a critic of the Vice-president and known supporter of President Rodrigo Duterte, Atty. Trixie Cruz-Angeles explained why Pangilinan's statement is incorrect.

In a Facebook post, Angeles said:
Kiko Pangilinan says Janet Napoles cannot be a state's witness because according to him, she is the mastermind in these cases.

The Rules of Court require the following:

(a) There is absolute necessity for the testimony of the accused whose discharge is requested;

(b) The is no other direct evidence available for the proper prosecution of the offense committed, except the testimony of said accused;

(c) The testimony of said accused can be substantially corroborated in its material points;

(d) Said accused does not appear to be the most guilty; and

(e) Said accused has not at any time been convicted of any offense involving moral turpitude.

So Kiko is incorrect. Because the crime here is plunder or graft. And the persons primarily punished under these laws are government officials. Napoles is not a government official but is involved in these cases by conspiracy. The ones who in accordance with the requirements stated above "appear the most guilty" would of course be the the government officials.

Meanwhile, according to the statement released on Monday by Pangilinan, president of the Liberal Party, Napoles acquittal is a 'bad sign' for pork barrel cases.
